Na gore navedenu e-mail adresu možete nam se obratiti izravno, bez odgode i bez dodatnih troškova, radi svih pitanja o proizvodima i narudžbama te radi podnošenja prigovora i reklamacija.

Ovim Uvjetima poslovanja uređuje se odnos između trgovca Houra grupa d.o.o. (dalje: trgovac, mi) i kupca u internetskoj trgovini 449jewelry.com. Uvjeti se primjenjuju na sve narudžbe zaprimljene putem te internetske trgovine i čine sastavni dio svakog sklopljenog ugovora.

Potrošač je svaka fizička osoba koja sklapa ugovor izvan svoje trgovačke, poslovne, obrtničke ili profesionalne djelatnosti. Odredbe ovih Uvjeta koje se izrijekom pozivaju na potrošača primjenjuju se samo na potrošače.

Ugovor se sklapa na hrvatskom jeziku. Engleska inačica ovih Uvjeta objavljena je radi lakšeg razumijevanja; u slučaju neslaganja mjerodavan je hrvatski tekst.

Tekst ovih Uvjeta trajno je dostupan na ovoj stranici te ga u svakom trenutku možete spremiti, ispisati i ponovno pročitati. Preporučujemo da ga spremite prilikom sklapanja ugovora.

Narudžbu mogu izvršiti punoljetne i poslovno sposobne osobe. Za narudžbe maloljetnika ili osoba lišenih poslovne sposobnosti odgovaraju njihovi zakonski zastupnici.

Trgovac ne primjenjuje poseban kodeks ponašanja koji bi bio obvezujući za ovaj ugovorni odnos, osim propisa navedenih u ovim Uvjetima.

Naziv proizvoda i njegova glavna svojstva, poput materijala, dimenzija, boje i načina izrade, navedeni su na stranici svakog pojedinog proizvoda. Fotografije su ilustrativne. Naš nakit izrađuje se u malim serijama i ručno se dovršava, pa su moguća manja odstupanja u nijansi i teksturi u odnosu na fotografiju.

Sve cijene iskazane su u eurima (EUR) i konačne su za potrošača, odnosno uključuju sve poreze i davanja.

U cijenu proizvoda nije uključen trošak dostave. Trošak dostave iskazuje se odvojeno u košarici i na blagajni, prije nego što potvrdite narudžbu, pa ukupan iznos koji plaćate vidite prije potvrde. Osim cijene proizvoda i troška dostave ne naplaćujemo nikakve dodatne manipulativne troškove.

Za narudžbe izvan Europske unije mogu se pri uvozu naplatiti carina, porezi i pristojbe zemlje odredišta. Njih plaća primatelj pošiljke i nisu uključene u iznos koji plaćate kod nas.

Vrijedi cijena istaknuta u trenutku zaprimanja narudžbe. Trgovac zadržava pravo izmjene cijena do trenutka zaprimanja narudžbe.

Ugovor se sklapa elektroničkim putem, kroz sljedeće korake:

1. odaberete proizvod, veličinu i količinu te ga dodate u košaricu;
2. u košarici provjeravate sadržaj narudžbe i možete mijenjati količine ili ukloniti proizvod;
3. na blagajni unosite podatke za dostavu i za račun;
4. odabirete način dostave i način plaćanja;
5. prije potvrde prikazuje se pregled cijele narudžbe s ukupnim iznosom, uključujući trošak dostave. U tom se koraku možete vratiti na bilo koji prethodni korak i ispraviti svaki uneseni podatak;
6. klikom na gumb kojim potvrđujete narudžbu i plaćanje sklapa se ugovor i nastaje obveza plaćanja.

Do trenutka potvrde narudžbe možete u svakom koraku ispraviti pogreške u unosu podataka povratkom na prethodni korak ili izmjenom sadržaja košarice.

Nakon zaprimanja narudžbe na Vašu e-mail adresu šaljemo potvrdu narudžbe s brojem narudžbe, popisom naručenih proizvoda, ukupnim iznosom, podacima za dostavu te obavijesti o pravu na jednostrani raskid ugovora. Ako potvrdu ne zaprimite, provjerite mapu neželjene pošte i javite nam se.

Narudžbu plaćate platnim karticama putem sustava CorvusPay. Prihvaćamo kartice Mastercard®, Maestro®, Visa, Diners, Discover i American Express. Logotipi kartica koje prihvaćamo prikazani su u podnožju svake stranice.

Naplata se obavlja u eurima (EUR). Iznos se s Vaše kartice tereti nakon uspješne autorizacije. Ako je valuta Vašeg kartičnog računa različita od eura, konverziju obavlja Vaša kartična kuća po svojim tečajevima i uvjetima, na što trgovac ne može utjecati.

Podatke o Vašoj platnoj kartici unosite izravno u sigurni platni formular CorvusPay sustava. Naša trgovina nikada ne dolazi u kontakt s cjelovitim podacima o Vašoj platnoj kartici i te podatke ne pohranjuje.

Ako plaćanje ne bude odobreno, ugovor se ne smatra sklopljenim, a narudžba se ne obrađuje.

Račun Vam dostavljamo elektroničkim putem, na e-mail adresu navedenu u narudžbi.

Narudžbe dostavljamo dostavnom službom na adresu koju ste naveli u narudžbi, na području Republike Hrvatske i u inozemstvo, ovisno o odredištu ponuđenom na blagajni.

Narudžbu pakiramo i predajemo dostavnoj službi u roku od dva radna dana od potvrde plaćanja. Uobičajeni rok isporuke unutar Republike Hrvatske je dva do pet radnih dana od predaje pošiljke dostavnoj službi, a za inozemstvo ovisi o odredištu. U svakom slučaju, proizvod isporučujemo najkasnije u roku od 30 dana od sklapanja ugovora, osim ako je s Vama dogovoreno drukčije.

Trošak dostave ovisi o odredištu i načinu dostave te se iskazuje u košarici i na blagajni prije potvrde narudžbe.

Ako Vam pošiljka bude uručena s vidljivim oštećenjem ambalaže, preporučujemo da je preuzmete uz napomenu dostavljaču i da nas o tome obavijestite bez odgode, kako bismo mogli pokrenuti postupak kod dostavne službe.

Ako proizvod ne isporučimo u ugovorenom roku, možete nam odrediti naknadni primjereni rok za isporuku, a ako ni tada ne isporučimo, imate pravo raskinuti ugovor i dobiti povrat cjelokupnog plaćenog iznosa.

Ako ste potrošač, imate pravo jednostrano raskinuti ovaj ugovor u roku od 14 dana, bez navođenja razloga.

Rok od 14 dana počinje teći od dana kada je Vama ili trećoj osobi koju ste odredili, a koja nije prijevoznik, roba predana u posjed. Ako je jednom narudžbom naručeno više komada koji se isporučuju odvojeno, rok teče od predaje posljednjeg komada.

Da biste ostvarili pravo na jednostrani raskid, morate nas prije isteka roka obavijestiti o svojoj odluci nedvosmislenom izjavom poslanom e-mailom ili poštom na adresu navedenu u poglavlju 1. U izjavi navedite ime i prezime, adresu, broj narudžbe, datum narudžbe i datum primitka robe, popis proizvoda koje vraćate te broj računa za povrat sredstava. Za tu svrhu možete upotrijebiti i obrazac o jednostranom raskidu ugovora propisan hrvatskim pravom. Rok se smatra poštovanim ako izjavu pošaljete prije isteka roka.

Povrat izvršavamo istim sredstvom plaćanja kojim ste se koristili prilikom plaćanja, osim ako izričito ne pristanete na drugo sredstvo, pri čemu ne snosite nikakve dodatne troškove. Povrat sredstava možemo odbiti dok ne primimo vraćenu robu ili dok nam ne dostavite dokaz da ste robu poslali natrag.

Odgovorni ste za svako umanjenje vrijednosti robe koje je rezultat rukovanja robom, osim onoga koje je bilo potrebno za utvrđivanje prirode, obilježja i funkcionalnosti robe. Molimo da nakit isprobavate pažljivo i da sačuvate originalno pakiranje.

Pravo na jednostrani raskid ne primjenjuje se, između ostalog, na ugovore o robi koja je izrađena po Vašoj specifikaciji ili jasno prilagođena Vama osobno, kao ni na zapečaćenu robu koja zbog zdravstvenih ili higijenskih razloga nije pogodna za vraćanje ako je nakon isporuke otpečaćena. To se odnosi i na naušnice te druge proizvode koji se nose u kontaktu s probušenim dijelom tijela, ako je zaštitno pakiranje otvoreno.

Odgovaramo za materijalne nedostatke proizvoda sukladno Zakonu o obveznim odnosima i Zakonu o zaštiti potrošača.

Ako proizvod ima nedostatak, obavijestite nas o tome e-mailom ili poštom na adresu iz poglavlja 1., uz opis nedostatka, broj narudžbe i po mogućnosti fotografiju. Obavijest o nedostatku dužni ste nam poslati u roku od dva mjeseca od dana kada ste nedostatak otkrili, a najkasnije u roku od dvije godine od primitka proizvoda.

Ako je reklamacija opravdana, možete birati između uklanjanja nedostatka i predaje drugog proizvoda bez nedostatka. Ako to nije moguće ili predstavlja nerazmjeran trošak, imate pravo na sniženje cijene ili na raskid ugovora uz povrat plaćenog iznosa. Troškove opravdane reklamacije, uključujući trošak povrata proizvoda, snosi trgovac.

Uobičajene promjene nastale nošenjem, poput blagog blijeđenja pozlate ili tamnjenja srebra, ne smatraju se materijalnim nedostatkom. Upute za održavanje isporučujemo uz proizvod.

Sukladno Zakonu o zaštiti potrošača omogućujemo Vam podnošenje pisanog prigovora na kvalitetu naših proizvoda i usluga.

Prigovor možete podnijeti:

• e-mailom na adresu navedenu u poglavlju 1.;
• poštom na adresu sjedišta trgovca navedenu u poglavlju 1.

Molimo da u prigovoru navedete svoje ime i prezime te adresu ili e-mail adresu na koju Vam možemo dostaviti odgovor. Bez tih podataka nismo u mogućnosti odgovoriti.

Primitak prigovora potvrdit ćemo Vam bez odgode, a pisani odgovor dostavit ćemo Vam najkasnije u roku od 15 dana od dana zaprimanja prigovora. O svim zaprimljenim prigovorima vodimo evidenciju koju čuvamo godinu dana od primitka prigovora.

Formular za upis platnih podataka osiguran je SSL transportnom šifrom najveće pouzdanosti. Svi skladišteni podaci dodatno su zaštićeni šifriranjem, korištenjem kriptografskog uređaja certificiranog prema FIPS 140-2 Level 3 standardu. CorvusPay zadovoljava sve zahtjeve vezane uz sigurnost online plaćanja propisane od strane vodećih kartičnih brandova, odnosno posluje sukladno normi PCI DSS Level 1, najvišem sigurnosnom standardu industrije platnih kartica. Pri plaćanju karticama uvrštenim u 3-D Secure program Vaša banka uz valjanost same kartice dodatno potvrđuje i Vaš identitet pomoću tokena ili lozinke.

CorvusPay sve prikupljene informacije smatra tajnom i tretira ih u skladu s tim. Informacije se koriste isključivo u svrhe za koje su namijenjene. Vaši osjetljivi podaci u potpunosti su sigurni, a njihova privatnost zajamčena je najmodernijim zaštitnim mehanizmima. Prikupljaju se samo podaci nužni za obavljanje posla sukladno propisanim zahtjevnim procedurama za online plaćanje.

Sigurnosne kontrole i operativne procedure primijenjene na našu infrastrukturu osiguravaju trenutnu pouzdanost CorvusPay sustava. Za sve što nije uređeno ovim Uvjetima primjenjuje se pravo Republike Hrvatske. Za rješavanje sporova nadležan je stvarno nadležni sud prema sjedištu trgovca, pri čemu se time ne dira u pravo potrošača na zaštitu prema propisima o zaštiti potrošača.

Svi sadržaji objavljeni na 449jewelry.com, uključujući tekstove, fotografije i grafičko oblikovanje, vlasništvo su trgovca ili se koriste uz odobrenje nositelja prava te se ne smiju koristiti bez pisanog odobrenja. These Terms of Business govern the relationship between the merchant Houra grupa d.o.o. and the buyer in the 449jewelry.com online store. They apply to every order placed through that store and form an integral part of every contract concluded.

A consumer is any natural person entering into a contract outside their trade, business, craft or professional activity. Provisions that expressly refer to a consumer apply to consumers only.

The contract is concluded in Croatian. This English version is published for ease of understanding; in case of any discrepancy the Croatian text prevails.

These Terms are permanently available on this page, and you can save, print and re-read them at any time. We recommend saving a copy when you place your order.

Orders may be placed by adults with legal capacity. Legal guardians are responsible for orders placed by minors or persons without legal capacity.

The merchant does not apply any specific code of conduct binding on this contractual relationship, beyond the legislation referred to in these Terms.

The name of each product and its main characteristics, such as material, dimensions, colour and finishing, are stated on the individual product page. Photographs are illustrative. Our jewelry is made in small runs and finished by hand, so slight variation in tone and texture compared to the photograph is possible.

All prices are shown in euro (EUR) and are final for the consumer, meaning they include all taxes and duties.

The product price does not include the delivery cost. The delivery cost is shown separately in the cart and at checkout before you confirm your order, so you see the full amount payable before confirming. Apart from the product price and the delivery cost we charge no additional handling fees.

For orders outside the European Union, customs duties, taxes and charges of the destination country may apply on import. These are paid by the recipient and are not included in the amount you pay to us.

The price displayed at the moment your order is received applies. The merchant reserves the right to change prices up to the moment an order is received.

The contract is concluded electronically, through the following steps:

1. you select the product, size and quantity and add it to the cart;
2. in the cart you review the contents of your order and can change quantities or remove a product;
3. at checkout you enter your delivery and billing details;
4. you choose the delivery method and the payment method;
5. before confirming, a summary of the whole order including the total amount and the delivery cost is displayed. At this step you can go back to any previous step and correct any detail you entered;
6. clicking the button that confirms the order and the payment concludes the contract and creates the obligation to pay.

Up to the moment you confirm the order you can correct input errors at every step, by returning to the previous step or by changing the contents of the cart.

Once your order is received we send an order confirmation to your e-mail address, containing the order number, the list of products ordered, the total amount, the delivery details and information on the right of withdrawal. If you do not receive it, please check your spam folder and contact us.

We keep the order confirmation together with these Terms in our records, and send it to you by e-mail in a form you can store, reproduce and print.

You pay for your order by payment card through the CorvusPay system. We accept Mastercard®, Maestro®, Visa, Diners, Discover and American Express. The logos of the cards we accept are shown in the footer of every page.

Payment is charged in euro (EUR). Your card is charged after a successful authorisation. If the currency of your card account differs from the euro, the conversion is performed by your card issuer at its own rates and terms, which the merchant cannot influence.

You enter your card details directly into the secure CorvusPay payment form. Our store never comes into contact with your full payment card data and does not store it.

If the payment is not authorised, the contract is not concluded and the order is not processed.

The invoice is delivered electronically, to the e-mail address given in the order.

Orders are delivered by courier to the address you gave in the order, within Croatia and abroad, depending on the destinations offered at checkout.

We pack your order and hand it to the courier within two working days of payment confirmation. The usual delivery time within Croatia is two to five working days from handover to the courier; for other countries it depends on the destination. In any case we deliver the product within 30 days of the conclusion of the contract at the latest, unless agreed otherwise with you.

The delivery cost depends on the destination and the delivery method, and is shown in the cart and at checkout before you confirm the order.

If your parcel is delivered with visibly damaged packaging, we recommend that you accept it noting the damage to the courier and inform us without delay, so we can open a claim with the courier.

If we fail to deliver within the agreed period, you may set an additional reasonable period for delivery, and if we fail to deliver within it as well, you have the right to terminate the contract and receive a refund of the full amount paid.

If you are a consumer, you have the right to withdraw from this contract within 14 days without giving any reason.

The 14-day period begins on the day when you, or a third party other than the carrier indicated by you, take physical possession of the goods. If several items ordered together are delivered separately, the period starts from the delivery of the last item.

To exercise the right of withdrawal you must inform us of your decision before the period expires, by an unequivocal statement sent by e-mail or by post to the address given in chapter 1. In your statement please state your name and surname, address, order number, order date and date of receipt of the goods, the list of products you are returning, and the account number for the refund. You may also use the withdrawal form prescribed by Croatian law. The deadline is met if you send your statement before the period expires.

You must return the goods without undue delay and no later than 14 days from the day on which you sent us your withdrawal statement. You bear the direct cost of returning the goods.

We will refund you without undue delay and no later than 14 days from the day we received your withdrawal statement. We refund using the same means of payment you used, unless you expressly agree otherwise, and you incur no fees as a result. We may withhold the refund until we have received the goods back or until you supply evidence of having sent them back.

You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning. Please try the jewelry on carefully and keep the original packaging.

The right of withdrawal does not apply, among others, to goods made to your specification or clearly personalised, nor to sealed goods which are not suitable for return due to health protection or hygiene reasons if they were unsealed after delivery. This also covers earrings and other products worn in contact with a pierced part of the body once the protective packaging has been opened.

We are liable for material defects of the products in accordance with the Croatian Civil Obligations Act and the Consumer Protection Act.

If a product has a defect, notify us by e-mail or post at the address in chapter 1, describing the defect, quoting the order number and, if possible, attaching a photograph. You must notify us of the defect within two months from the day you discovered it, and no later than two years from receipt of the product.

If the claim is justified, you may choose between having the defect remedied and receiving a replacement product without defect. If that is impossible or would involve disproportionate cost, you are entitled to a price reduction or to terminate the contract with a refund of the amount paid. The costs of a justified claim, including the cost of returning the product, are borne by the merchant.

Ordinary changes caused by wear, such as slight fading of gold plating or tarnishing of silver, are not considered material defects. Care instructions are supplied with the product.

In accordance with the Croatian Consumer Protection Act we enable you to submit a written complaint about the quality of our products and services.

You can submit a complaint:

• by e-mail to the address given in chapter 1;
• by post to the registered address of the merchant given in chapter 1.

Please state your name and surname and the address or e-mail address at which we can send you our reply. Without those details we cannot respond.

We will confirm receipt of your complaint without delay and send you a written reply no later than 15 days from the day the complaint was received. We keep a record of all complaints received for one year from receipt.

While conducting payments on our web shop you are using CorvusPay, an advanced system for secure acceptance of credit cards on the Internet.

CorvusPay system ensures complete privacy of your credit card data and personal data from the moment you type them into the CorvusPay payment form. Data required for billing is forwarded encrypted from your web browser to the bank that issued your payment card. Our store never comes into contact with your sensitive payment card data. Similarly, CorvusPay operators cannot access your complete cardholder data. An isolated system core independently transmits and manages sensitive data while at the same time keeping it completely safe.

The form for entering payment data is secured by an SSL transmission cipher of the greatest reliability. All stored data is additionally protected by hi-grade encryption, using hardware devices certified by FIPS 140 2 Level 3 standard. We seek to resolve all disputes amicably, in direct contact with the buyer. If you believe your rights have been infringed, please first contact us with a complaint as described in chapter 9.

If no agreement is reached, a consumer may refer the dispute to a body for alternative consumer dispute resolution, in accordance with the Croatian Act on Alternative Resolution of Consumer Disputes. In Croatia these include the Court of Honour of the Croatian Chamber of Economy and the Mediation Centre of the Croatian Chamber of Economy.

Everything not governed by these Terms is subject to the law of the Republic of Croatia. Disputes fall under the jurisdiction of the competent court at the registered seat of the merchant, without prejudice to the consumer protection rights afforded to consumers.
